Terms of Use

These terms of use (the “Terms of Use”) and other policies (including but not limited to Privacy Policy) govern your use of our website www.thepetsquad.in (the “Website”) and our “PetSquad” application (the “App”) for mobile. The Website and the App are jointly referred to as the “Platform”. Please read these Terms of Use carefully before you use the services. If you do not agree to these Terms of Use, you may not use the services on our Platform, and we request you to uninstall the App. By installing, downloading or even merely using the Platform, you shall be contracting with PetSquad and you signify your acceptance to this Terms of User and other PetSquad policies (including but not limited to Privacy Policy) as posted on the Platform and amended from time to time, which takes effect on the date on which you download, install or use the Platform, and create a legally binding arrangement to abide by the same.

The Platform is owned and operated by DKMV TECHX CONSULTING LLP, a company incorporated under the laws of India and having its registered office at Flat No. DG-1, DonVaddo, Salvador Do Mundo, Bardez, Goa – 403101. For the purpose of these Terms of Use, wherever the context so requires, “You”, “user”, “users”, or “User” shall mean any natural or legal person who shall transact on the Platform by providing registration data during the registration on the Platform as a registered user using any computer systems. The terms “PetSquad”, “we”, “us” or “our” shall mean DKMV TECHX CONSULTING LLP.

1. Account Registration

  1. You are required to register first to access all features and benefits on the App.
  2. Only accurate and verified information will be accepted under the law governing the State and Country.
  3. You are expected to keep your credentials safe while using the App. We will not be liable for information provided outside the purview of the App requirements.

2. Use of the App

  1. The App contains information and resources related to pet services, including online vet consultations, grooming services, kennel services, pet stores, and animal shelters.
  2. The App is only operating an online marketplace and assume the role of facilitator, and does not at any point of time during any transaction between user and merchant on the Platform come into or take possession of any of the services offered by the merchants.
  3. You agree to use the App only for lawful purposes and by these Terms of Use.

3. Merchants

  1. The App connects users to various services and products listed and offered for sale by merchants including but not limited to vets, pet stores, pet pharmacies, pet shelters, pet kennels and pet groomers (“Merchant/s”).
  2. The App does not have any control or does not determine or advise or in any way involve itself in the offering or acceptance of commercial/contractual terms between user and merchants. The price of the service offered by the merchants itself and we have no role to play in such determination of price in any way whatsoever.
  3. For any product or service, we are merely acting as an intermediary between the Merchant and the User. We are not responsible for any unsatisfactory or non-performance of services or breach of contract entered into between the User and the Merchant. In case of complaints from the User regarding the products and/or services, we will notify the same to the merchant and may also redirect the user to the merchant.

4. Orders booking and Payment terms

  1. The App will accept payments for any orders for online vet consultation services from various merchants via approved payment gateway.
  2. The User shall be required to provide credit or debit card details to the approved payment gateways while making payments on the App. In this regard, the User agrees to provide correct and accurate credit/debit card details to the approved payment gateway for availing the services. The User shall not use the credit/debit card which is not lawfully owned by the user. We expressly disclaim all liabilities that may arise as a consequence of any unauthorised use of your credit/debit card. 
  3. We do not offer any refunds against services already purchased from a Merchant through the App unless there is an error that is directly attributable to PetSquad has occurred during the purchase of such services.
  4. All payments made against the services on the App by you shall be compulsorily in Indian Rupees acceptable in the Republic of India. The App will not accept any other form of currency with respect to the services used on the App. You can pay by credit/debit card, net banking or any other RBI approved payment method at the time of booking the service.

5. User Content

  1. Feel free to post pictures of your pets and other refreshing content for the benefit of the community.
  2. Plagiarised, AI-generated images and other content related to animal cruelty will be banned and subject to termination from the App. While you retain ownership of your content, you grant us a non-exclusive, royalty-free, perpetual, and worldwide license to use, display, and distribute your content.

6. Privacy and Security

  1. We are committed to protecting your privacy. Please refer to our Privacy Policy for information on how we collect, use, and protect your personal information.
  2. As much as we take stringent measures to ensure the security and safety of our users, we cannot guarantee the security of your data transmitted through the App. Sharing extremely personal information should be done at the risk of the user.
  3. You agree and grant permission to PetSquad to receive promotional SMS from PetSquad or allied partners. In case you wish to opt out of receiving promotional SMS, please send a mail to support@thepetsquad.in

7. Changes to Terms

  1. We reserve the right to modify these Terms of Use at any time. These modifications will be posted on the Platform and updated to users as and when applicable.

8. Termination

  1. Violation of any of the following terms, especially in cases of use of foul language, abuse, violence, and unlawful act, will result in immediate termination. The rights of suspension and termination remain at our discretion.

9. Governing Law and dispute resolution

  1. These Terms of Use are governed by and construed in accordance with the laws of India. Any action, suit or other legal proceeding, which is commenced to resolve any matter arising under or relating to this platform, shall be subject to the jurisdiction of the courts at Goa, India.

12. Disclaimers

THE PLATFORM MAY BE UNDER CONSTANT UPGRADE, AND SOME FUNCTIONS AND FEATURES MAY NOT BE FULLY OPERATIONAL.

DUE TO THE VAGARIES THAT CA OCCUR IN THE ELECTRONIC DISTRIBUTION OF INFORMATION AND DUE TO THE LIMITATIONS INHERENT IN PROVIDING INFORMATION OBTAINED FROM MULTIPLE SOURCES, THERE MAY BE DELAYS, OMISSIONS OR INACCURACIES IN THE CONTENT PROVIDED ON THE PLATFORM OR DELAY OR ERRORS IN THE FUNCTIONALITY OF THE PLATFORM. AS A RESULT, WE DO NOT REPRESENT THAT THE INFORMATION POSTED IS CORRECT IN EVERY CASE.

WE EXPRESSLY DISCLAIM ALL LIABILITIES THAT MAY ARISE AS A CONSEQUENCE OF ANY UNAUTHORIZED USE OF CREDIT/DEBIT CARDS.

PETSQUAD DISCLAIMS AND ALL LIABILITY THAT MAY ARISE DUE TO ANY VIOLATION OF ANY APPLICABLE LAWS INCLUDING THE LAW APPLICABLE TO PRODUCTS AND SERVICES OFFERED BY THE MERCHANTS.

WE SHALL NOT BE LIABLE TO YOU OR ANYONE ELSE FOR ANY LOSSES OR INJURY ARISING OUT OF OR RELATING TO THE INFORMATION PROVIDED ON THE PLATFORM. IN NO EVENT WILL WE OR OUR EMPLOYEES, AFFILIATES, AUTHORS OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DECISION MADE OR ACTION TAKEN BY YOUR RELIANCE ON THE CONTENT CONTAINED HEREIN.

IN NO EVENT WILL WE BE LIABLE FOR ANY DAMAGES (INCLUDING, WIHTOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, DAMAGES ARISING FROM PERSONAL INJURY/WRONGFUL DEATH, AND DAMAGES RESULTING FROM LOST PROFITS, LOST DATA OR BUSINESS INTERRUPTION), RESULTING FROM ANY SERVICES PROVIDED BY ANY MERCHANT ACCESSED THROUGH THE PLATFORM.
